Instagram Affiliate Link Disclosure Rules — What Creators Must Know in 2026

Instagram's new affiliate link feature makes it easier than ever to earn from Reels. But easier monetization doesn't mean fewer rules. The FTC's disclosure requirements haven't changed — and violations can result in fines, account restrictions, or loss of affiliate program access.

Here's exactly what you need to do to stay compliant.

The Basic Rule

If you could earn money from someone clicking a link or buying a product you recommend, you must disclose that relationship. This applies whether it's a paid sponsorship, an affiliate link, a gifted product, or any financial incentive. Instagram's native product tags don't exempt you from this requirement.

How to Disclose Properly

What Works

#ad or #affiliate — at the beginning of your caption, not buried in hashtags

"I earn a commission if you buy through this link" — clear, direct language

On-screen text in the Reel — "affiliate link" visible while showing the product

Instagram's Paid Partnership label — for sponsored content (separate from affiliates)

What Doesn't Count as Disclosure

#sponsored buried at the end of 30 hashtags — must be visible and prominent

"Thanks to [brand]" — appreciation isn't disclosure

Nothing at all — even if the affiliate tag is "obvious," the FTC requires explicit disclosure

Where to Put Your Disclosure

Content TypeWhere to Disclose
Reel with product tagsFirst line of caption + on-screen text
Story with link stickerText overlay near the sticker
Bio link pageDedicated disclosure page (linked from bio)
Comment with linkIn the same comment as the link

What Happens If You Don't Disclose

The FTC has been increasingly active with enforcement. Consequences can include warning letters, fines (up to $50,000+ per violation in serious cases), and affiliate program termination. Amazon Associates specifically requires disclosure — failing to comply can get your account banned and all unpaid commissions forfeited.

The easy fix: make disclosure a habit on every post with any affiliate or sponsored element. It takes 2 seconds and protects your entire business.
